ThriftBite Terms of Use

These Terms of Use apply to buyers and vendors using ThriftBite. By creating or using an account, you agree to these Terms and the ThriftBite Privacy Policy.

1. Marketplace Role

ThriftBite provides a marketplace that connects buyers with independent food vendors. Vendors control their listings, pricing, availability, preparation, and fulfillment. Unless expressly stated otherwise, ThriftBite does not prepare or manufacture the food sold by vendors.

2. Buyer Responsibilities

  • Review item descriptions, pickup/delivery details, ingredients, and any vendor-provided allergen information before purchase.
  • Provide accurate contact, payment, pickup, and delivery information.
  • Use the service lawfully and only for legitimate marketplace transactions.

3. Vendor Responsibilities

  • Provide accurate business, product, pricing, availability, ingredient, and fulfillment information.
  • Maintain all licenses, permits, insurance, food-handling practices, and regulatory compliance required for the vendor's business.
  • Ensure listed food is lawful, safe, accurately described, and suitable for sale.
  • Fulfill accepted orders and handle buyer issues in accordance with applicable law and the vendor's disclosed policies.

4. Payments and Payouts

Buyer payments for physical food and marketplace orders are processed by Stripe or another disclosed payment provider. Vendor payouts may be processed through Stripe Connect. Applicable marketplace fees or commissions may be deducted before payout where disclosed in the vendor workflow.

5. Delivery and Pickup

Orders may be offered for pickup or supported third-party delivery depending on vendor and regional availability. Third-party delivery services operate under their own terms and availability.

6. Optional Vendor AI Tools

ThriftBite may provide optional AI-assisted tools to help vendors draft listing content or generate listing images. Vendors remain responsible for reviewing generated content for accuracy, rights, safety, and compliance before publishing it.

7. Accounts

You are responsible for maintaining control of your account and authentication methods. ThriftBite may suspend or terminate access for fraud, abuse, security threats, unlawful activity, or material violation of these Terms. Users may initiate account deletion from the account/profile menu inside the app.

8. Prohibited Conduct

You may not misuse the service, attempt unauthorized access, interfere with service operation, submit unlawful or infringing content, misrepresent products or identity, commit fraud, or use ThriftBite in a way that violates applicable law.

9. Content and Intellectual Property

Vendors retain responsibility for content they submit and represent that they have the rights needed to use and publish it. ThriftBite's software, branding, and platform materials remain protected by applicable intellectual-property laws.

10. Disclaimers and Liability

Marketplace inventory, vendor availability, delivery availability, and third-party services may change. To the extent permitted by law, ThriftBite is not responsible for acts or omissions of independent vendors or third-party delivery/payment providers. Nothing in these Terms excludes rights or remedies that cannot legally be excluded.
